FAMLI Program

As of January 1, 2023, employers with workers based in Colorado are being assessed a premium so the state can provide a family and medical leave benefit to all eligible workers. For most Colorado employers, participation in the Family and Medical Leave Insurance program (FAMLI) is mandatory. Famli Program

All employers are expected to participate in the Colorado FAMLI program. Employers can decide if they want to administer the FAMLI program through an approved private plan, or through the State of Colorado. MJ Absence Management can run a detailed analysis of your organization to help you understand FAMLI’s financial impact and determine your best plan to understand important dates and deadlines. On January 1, 2023, premium contributions began. The deadline to apply for a private plan is October, 2023 with an effective date of January 1, 2024.

All public and private employers with at least one eligible employee in the state of Colorado who have paid wages of $1,500 or more are eligible for the program. Local governments can opt out via vote.

Employees who have contributed to the FAMLI fund and earned at least $2,500 in wages in the qualifying period are eligible.

Eligible beneficiaries will have twelve weeks of paid benefits with an additional four weeks if related to pregnancy or childbirth complications.

Employees will pay a maximum of 50% of the total rate, while employers pay a minimum of 50% of the total rate. The total premium rate is 0.9% of wages capped at $160,200. Employers may pay the employee contributions, but employers with fewer than ten employees are not required to pay the employer contribution.

Employees may use paid sick time, vacation or any other paid leave earned by the employee in addition to receiving family and medical leave insurance benefits to replace wages up to 100% of the employee’s average weekly wage. Benefits are calculated on a sliding scale using the individual’s average weekly wage from the previous five calendar quarters in relation to the average weekly wage for the state of Colorado and may increase over time. Benefits are capped at $1,100 per week.

Every employer that would like to consider meeting their FAMLI obligations with a private plan will need to have their plan approved by the Division. The private plan must demonstrate that it provides equal or greater benefits and protections as the FAMLI plan.
